Sheet 7 - Renewal of the non-profit temporary residence permit

TYPE OF AUTHORISATION 

It is the renewal of the authorization of non-profit residence.

BASIC REGULATIONS 

  • Organic Law 4/2000 of 11 January on the rights and freedoms of foreigners in Spain and their social integration (articles 30 bis and 31).
  • Royal Decree 1155/2024, of 19 November, approving the Regulations of Organic Law 4/2000, of 11 January, on the rights and freedoms of foreigners in Spain and their social integration (article 64).

REQUIREMENTS 

  • Not to be a citizen of a State of the European Union, of the European Economic Area or of Switzerland, or a family member of citizens of these countries to which the regime of citizen of the Union applies.
  • Lack of criminal records in Spain and in the countries where he has resided for the last five years, for crimes existing in the Spanish legislation.
  •  Not to appear as rejectable in the territorial space of countries with which Spain has signed an agreement in this regard.
  • Be holder of an authorization of temporary non-profit residence in force or be within three months of its expiry.
  • Have sufficient economic means to meet their living and living expenses, including, where applicable, those of their family, during the period of time for which the renewal corresponds, without the need to carry out any work or professional activity,
  • Have maintained during the validity of the authorization that is intended to be renewed and continue with a health insurance. 
  • To have children under their care in school at the age of compulsory schooling during their stay in Spain.
  • Pay the corresponding fee for the processing of the procedure.
  • To have resided in a real and effective way in Spain for more than one hundred and eighty-three days during the calendar year.

EXIGIBLE DOCUMENTATION 

Note: in general, copies of the documents must be provided and the originals must be displayed at the time of submitting the application, when the application is face-to-face. 

  • Copy of the complete passport or travel title in force, recognized as valid in Spain.
  • Documents that demonstrate sufficient economic resources to meet your living and living expenses, as well as health insurance, during the period of time for which it is intended to renew the residence in Spain without the need to carry out any work or professional activity.
  • If they are responsible for minors of compulsory school age, a report issued by the competent regional authorities certifying their enrolment.
  • Where appropriate, the integration effort of the foreign person accredited through the positive report of the Autonomous Community of his/her place of residence will be valued.

Important note: when documents are provided from other countries they must be translated into Spanish or co-official language of the territory where the application is submitted by a sworn translator.

On the other hand, any foreign public document must be previously legalized by the Consular Office of Spain with jurisdiction in the country in which the document has been issued or, as the case may be, by the Ministry of Foreign Affairs, European Union and Cooperation, except in the case where the document has been apostilled by the competent authority of the issuing country in accordance with the Hague Convention of 5 October 1961 and unless the document is exempt from legalization under the International Convention.

PROCEDURE 

  • Subject entitled to submit the application: the foreign person who holds the authorization of temporary non-profit residence.

  • Place of presentation: 

Address information, telephone numbers and hours of service to the public. 

  • Application period: during the two months prior to the expiration date of the validity of your authorization. It can also be requested within three months of the date on which the validity of the authorization has ended, without prejudice to the possibility of the corresponding sanctioning procedure being initiated.
  • The submission of the application in due time extends the validity of the previous authorisation until the termination of the procedure.
  • The renewed temporary residence permit shall be valid for two years, unless it is appropriate to obtain a long-term or long-term EU-residence permit.
  • Corresponding fee: it will accrue at the time of filing the application, and must be paid within ten working days:

  • Deadline for resolution of the application: three months from the submission of the application. Once this period has elapsed without the Administration having made the notification, it may be understood that the application has been estimated by administrative silence. The body competent to grant the authorization must issue, at the request of the interested party, a certificate attesting to the renewal for this reason. (When it has not been possible to notify the resolution, it will be announced in the Single Edictal Board . If an electronic notification has been chosen or if a regulatory obligation has been placed on the use of this medium, the decision shall be notified by publication in the electronic office. If the resolution is not accessed within ten calendar days of its publication, it shall be deemed to have been notified).
  • Notification of the resolution. When the notification by electronic means is mandatory, or has been expressly chosen by the interested party, the administration will make it available to you at the single qualified electronic address and, where appropriate, in a complementary manner, also at the corresponding electronic headquarters. If the interested party does not accede to it within ten calendar days, the notification will be understood rejected. In the other cases in which it is appropriate to make the notification on paper, it will be made at the address of the interested party and, if it proves to be unsuccessful, it will be done by means of an announcement published in the Tablón Edictal Unico (TEU).
  • Within one month of notification of the renewal of the temporary residence permit, the foreign person must request the renewal of the alien identity card at the competent Police Station or police services of his/her place of residence.
