TYPE OF AUTHORISATION 

It is the renewal of the authorization of temporary residence and self-employment.

BASIC REGULATIONS 

  • Organic Law 4/2000, of 11 January, on the rights and freedoms of foreigners in Spain and their social integration (articles 25 bis, 36 and 37).
  • Royal Decree 1155/2024, of 19 November, approving the Regulations of Organic Law 4/2000, of 11 January, on the rights and freedoms of foreigners in Spain and their social integration (articles 86 and 87).

REQUIREMENTS 

  • Not to be a citizen of a State of the European Union, of the European Economic Area or of Switzerland, or a family member of citizens of these countries to which the regime of citizen of the Union applies.
  • Lack of criminal record in Spain and in the countries where he has resided for the last five years, for crimes existing in the Spanish legislation.
  • Do not pose a threat to public order, safety or public health 
  • Not to appear as rejectable in the territorial space of countries with which Spain has signed an agreement in this regard.
  • Where appropriate, to certify the schooling of children of compulsory school age.
  • Be able to prove one of the following assumptions:  
  • Continue with the activity that gave rise to the authorization that is to be renewed, provided that the tax and social security obligations have been fulfilled.
  • When a relative, defined in the terms of Article 66 of the Regulation (family members who are reunifiable), complies with the economic requirements to regroup the working person.
  • Be a beneficiary of the protection for cessation of activity.
  • In the case of economically dependent self-employed workers, when the contract is interrupted or terminated for reasons beyond the control of the self-employed person, including economically dependent self-employed workers who are victims of gender violence or sexual violence.
  • When the worker is in any of the situations provided for in article 38.6 (b) and (c) of Organic Law 4/2000 of 11 January:
  • When a contributory unemployment benefit has been granted by the competent authority, in accordance with Social Security regulations.
  • When the foreign person is a beneficiary of an economic assistance benefit of a public nature intended to achieve his social or employment insertion.
  • Pay the fee for the processing of the procedure.

EXIGIBLE DOCUMENTATION 

Note: in general, copies of the documents must be provided and the originals must be displayed at the time of submitting the application. 

  • Full copy of the passport or travel title in force.
  • Where appropriate, report issued by the autonomous authorities, or those competent in each case, or by the educational establishment accrediting the schooling of minors under their care who are of compulsory school age.
  • Documentation according to the case for which the renewal is requested:  
  • If the relative has sufficient economic requirements to regroup the worker.  
  • Documentation to be provided:  
  • Updated documentation accrediting the family link.
  • Accreditation of economic media.
  • If you have granted protection by cessation of activity.  
  • Documentation to be provided:  
  • Accreditation of the granting of protection.
  • If the interruption or termination of the contract occurs for reasons beyond the control of the self-employed person:
  • Documentation to be provided:  
  • Documentation accrediting the interruption or termination of the contract for reasons beyond their control.

In the event of not being able to prove any of the required requirements, it may be provided, for assessment by the Aliens Office, of a positive report of the integration effort of the Autonomous Community of its place of residence in which participation in training actions and knowledge of the official languages are recorded.

Important note: when documents are provided from other countries they must be translated into Spanish or co-official language of the territory where the application is submitted by a sworn translator.

On the other hand, any foreign public document must be previously legalized by the Consular Office of Spain with jurisdiction in the country in which the document has been issued or, as the case may be, by the Ministry of Foreign Affairs, European Union and Cooperation, except in the case where the document has been apostilled by the competent authority of the issuing country in accordance with the Hague Convention of 5 October 1961 and unless the document is exempt from legalization under the International Convention.

PROCEDURE 

  • Legitimate subject to submit the application: the worker personally or through representation.

  • Place of presentation:  

Address information, telephone numbers and hours of service to the public. 

  • Application period: during the two months prior to the expiration date of the validity of the authorization. It can also be requested within three months of the date on which the validity of the authorization has ended, without prejudice to the possibility of the corresponding sanctioning procedure being initiated.
  • The submission of the application in due time extends the validity of the previous authorisation until the termination of the procedure.
  • Corresponding rates of residence and work: will accrue at the time of submission of the application, and must be paid within ten working days:  
  • Model 790 code 052, section 2.2.3. “Renovation of temporary residence and employment and self-employment”.
  • Model 790 code 062, heading 3.3.2 “Work authorization for renewed authorizations of temporary self-employment residence”.

  • Deadline for the resolution of the application: three months from the day following the date on which it entered the register of the competent body for processing. Once this period has elapsed without the Administration having made the notification, it may be understood that the application has been estimated by administrative silence. (When it has not been possible to notify the resolution it will be announced in the Single Bulletin Board (TEU) If an electronic notification has been chosen or it is legally obliged to use that means, the resolution will be notified by publication in the electronic headquarters. If the resolution is not accessed within ten calendar days of its publication, it will be given as notified). 
  • The validity of the renewal of the residence and self-employment authorization is four years, unless a long-term residence authorization applies, and it shall entitle the person to work as an employed and self-employed person in any part of the national territory and in any sector of activity.
  • Within one month of notification of the renewal, the worker must personally request the identity card of a foreigner at the competent Police Station or police services of his place of residence.
