On September 1, the Ministry of Inclusion, Social Security and Migration published, in accordance with the provisions of article 133.1 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, in relation to article 26.2 of Law 50/1997, of November 27, of the Government, prior to the elaboration of the articulated draft of the preliminary draft of the Ministerial Order creating and regulating the Electronic Registry of Collaborators of Foreigners, a public consultation with the aim of obtaining the opinion and proposals for improvement of the subjects and organizations potentially affected by the most representative norm.
Any interested parties may participate by sending their contributions through the web portal of the Ministry of Inclusion, Social Security and Migration, “Public participation in normative projects”, subsection “Prior public consultation”, in accordance with the Agreement of the Council of Ministers of 30 September 2016, which provides instructions to enable public participation in the process of normative elaboration through the web portals of the ministerial departments, published by Order PRE/1590/2016, of 3 October.

From this General Directorate of Migration Management, it is communicated the origin of assigning a Social Security number (NUSS) and, where appropriate, processing the discharge in the Social Security System that corresponds to foreign persons who, under the second transitory provision of Royal Decree 1155/2024, of 19 November, approving the Regulation of Organic Law 4/2000, of 11 January, on the rights and freedoms of foreigners in Spain and their social integration, request the application of the legal regime included in this regulation and that, as a result, request the authorization to work in accordance with this regulation.

The entry into force of the Regulation on Foreigners approved by Royal Decree 1155/2024, of 19 November (new RLOEx), entails, beyond the application of a new legal regime, a series of modifications whose implementation is of considerable complexity.
One of them is the application of an updated fee system to the procedures regulated therein. Thus, the new “Order establishing the amount of fees for processing administrative authorizations, applications for border visas and identity documents on immigration and foreigners” is pending publication, which will take place in the next few days.
Therefore, in order to increase efficiency in the processing of applications submitted in the first days of the new RLOEx and avoid erroneous subscriptions, the payment of fees 052 and 062 is blocked (not the possibility of submitting applications) and, in application of the third paragraph of its twelfth Additional Provision, a deadline is opened so that they can be paid within 10 working days following the publication in the BOE of the Order establishing the fees for the procedures regulated in the new RLOEx.

Notification of non-requirement of withdrawal of international protection

Given the exceptional nature and outside the scope of the general regime of Aliens of the residence permits provided for in the Resolution of 12 February 2025 of the Secretariat of State for Migration, which publishes the Agreement of the Council of Ministers of 11 February 2025, the prior withdrawal of the application for international protection of persons in such a situation will not be required to access one of these permits.
Interpretative Criterion on the Global Computation of the Weekly Working Time in Arraigos, of RD 1155/2024, of November 19

Joint instruction by the Director General of Migration Management and the Commissioner General of Immigration and Borders in which expired Venezuelan passports are reaccepted

Today, 14 January 2025, the Joint Instruction of the DG for Migration Management and the Commissioner General for Foreigners and Borders has been published in which expired Venezuelan passports are reaccepted. The improvement in the services of renewal of Venezuelan passports in the consular offices of Venezuela in Spain has not been perfected in its entirety, detecting that many Venezuelan citizens continue to be unable to renew their passport and, therefore, to access the procedures of foreigners, so that, from the day of the date of the aforementioned Instruction, the expired passports of those Venezuelan nationals will be granted validity for the processing and continuation of any of the authorizations and permits regulated in the regulations of foreigners, as well as for the issuance and delivery of the identity card of foreigners.

Agreement between the Secretariat of State for Migration and the General Treasury of Social Security, for the transfer of data.
05-11-2024 - The Official State Gazette (BOE) published on November 4, 2024 the Resolution of October 23, 2024, of the Technical General Secretariat, which publishes the Agreement between the State Secretariat for Migration and the General Treasury of Social Security, for data transfer, which will be useful for us because of the following:
Firstly, with regard to aliens, this cooperation is considered to be necessary both for the purposes of verification of the maintenance of requirements that led to the granting of residence permits and, in general, as a means of simplification of certain procedures.
Thus, the Regulation of Organic Law 4/2000, of January 11, on the rights and freedoms of foreigners in Spain and their social integration, approved by Royal Decree 557/2011, of April 20, regulating the procedures of initial residence and work authorizations, establishes, among the requirements to access them, that the employer is current in the fulfilment of his obligations towards Social Security, being the body competent to request this report ex officio the General Directorate of Migration Management, the Offices of Foreigners or the corresponding one of the autonomous community, in the case that has assumed competence in the matter.
Likewise, Law 14/2013, of September 27, on support for entrepreneurs and their internationalization, also establishes among the requirements required of obligated subjects for residence or stay authorizations, which is processed by the Unit of Large Companies and Strategic Groups, the fulfillment of Social Security obligations.
Secondly, the General Directorate of Spanish Citizenship Abroad and Return Policies, manages welfare benefits and aids in the processing of which it is necessary to verify the possible discharge of their applicants and cohabiting relatives, in order to verify the income declared by them.
Thirdly, with regard to the aids and subsidies that are managed within the scope of the SEM and, in particular, those managed by both the General Directorate of Migration Management and the General Directorate of Spanish Citizenship Abroad and Return Policies, Article 12 of Law 38/2003, of 17 November, General of Subsidies, establishes in its Article 13.2, section e,) that “persons or entities in which some of the following conditions are imposed may not obtain the status of beneficiary or collaborating entity of the subsidies regulated in this law (…) in relation to the current form of taxation.”
Finally, it is also up to the Directorate-General for Humanitarian Assistance and the International Protection Reception System, as the coordinating body responsible for granting the authorisation for concerted action – both for the management of the international protection reception system and for the management of humanitarian assistance programmes – to verify that the requesting entities are aware of tax and social security obligations.
Therefore, due to the foregoing and in accordance with the provisions of current legislation, the SEM and the TGSS agree to sign this collaboration agreement between both bodies, which is a step forward in the interconnection between Administrations.
