TYPE OF AUTHORISATION 

It is an authorization of temporary residence due to exceptional circumstances that may be granted to foreign persons who are in Spain on a continuous basis for a minimum period of two years and are registered or studying any of the formations referred to in articles 52.1.b) and 52.1.e) 5º of Royal Decree 1155/2024 (RLOEX), to the face-to-face offer of compulsory education within the education of adults or undertake to carry out a training promoted by the Public Employment Services in Spain oriented to the performance of occupations included in the catalogue of occupations of Autonomous Communities. In addition, they must justify integration into Spanish society through a social integration report issued by the Autonomous Community or, where appropriate, by the City Council, in whose territory the applicant has his habitual domicile, as well as certify the completion of such training.

BASIC REGULATIONS 

  • Organic Law 4/2000, of 11 January, on the Rights and Freedoms of Foreigners in Spain and their Social Integration (art. 31.3).
  • Royal Decree 1155/2024, of 19 November, approving the Regulations of Organic Law 4/2000, of 11 January, on the rights and freedoms of foreigners in Spain and their social integration (articles 125 to 127.d) and 128 to 130).

REQUIREMENTS 

  • Not to be a citizen of a State of the European Union, of the European Economic Area or of Switzerland, or a family member of citizens of these countries to which the regime of citizen of the Union applies.
  • To be in Spain and not to have the status of applicant for international protection at the time of submission of the application or during its processing.

An applicant for international protection shall mean a foreign person who has made an application for international protection on which no final decision has been taken in an administrative, and, where appropriate, judicial, office.

  • Lack of criminal records in Spain and in the countries where he has resided for the last five years, for crimes existing in the Spanish legislation.  
  • Not to appear as rejectable in the territorial area of countries with which Spain has signed an agreement in this regard.
  • Not to be found, where appropriate, within the period of commitment of no return to Spain that the foreign person has assumed when voluntarily returning to their country of origin.
  • Not to be the holder of a residence permit or to hold the status of a person interested in procedures aimed at the granting, extension, renewal or modification of residence permits.  
  • Do not pose a threat to public order, safety or public health.  
  • To have remained continuously in Spain for at least the two years preceding the filing of such an application. For this requirement to be met, the absences of Spain during this period cannot exceed 90 days.  

When the foreign person has been an applicant for international protection, the time of stay in Spain during the processing of the application for international protection will not be computable until its final decision in administrative, and, where appropriate, judicial headquarters.

  • Be enrolled or taking any of the following courses:  
  • Realization of post-compulsory secondary education studies in an authorized educational center in Spain within the framework of a full-time program, leading to the achievement of a recognized degree (art. 52.1.b) RLOEX).
  • Completion of a complete training in an authorized educational center in Spain, leading to the obtaining of professional certificates of the offers of the professional training system of grade C, in its levels 2 and 3, with the requirements and conditions established in Organic Law 3/2022, of March 31, of organization and integration of the Professional Training and its development regulations (art. 52.1 (e) 5º) RLOEX), level 1 is also included, as well as the face-to-face offer corresponding to compulsory education in adult education (art. 52.1.e) RLOEX).
  • Likewise, foreign persons who commit to carry out a training promoted by the Public Employment Services in Spain may apply for a temporary residence permit due to socio-educational roots.
  • Along with the above requirements, a social integration report will be required in Spain.
  • Commit to conducting a training: 
  • Promoted by the Public Employment Services and oriented to the performance of occupations included in the Catalogue referred to in article 65.1 (Catalogue of occupations of difficult coverage, you can consult it by clicking here).
  • To this end, the registration test must be accredited to the Aliens Office within three months of notification of the decision to grant the residence permit.
  • Pay the fee corresponding to the processing of the procedure.  

EXIGIBLE DOCUMENTATION 

Note: in general, copies of the documents must be provided and the originals must be displayed at the time of submitting the application.  

  • Full copy of the passport registration card or travel certificate in force, recognized as valid in Spain.
  • Documentation accrediting the continued stay in Spain for a minimum period of two years. The documentation provided must contain the identification data of the applicant, preferably it must have been issued and/or registered by a Spanish Public Administration. By way of example, documents relating to registration, hospitalization, a medical consultation in public health will be taken into consideration, as well as any municipal, regional or state documentation that justifies the presence in Spain.
  • Criminal record certificate issued by the authorities of the country or countries in which you have resided during the last five years prior to entry into Spain.
  • Social integration report issued by the Autonomous Community or, in which case, by the City Council, in whose territory the applicant has his habitual domicile.  
  • Commitment to carry out the training, reflected in the official model of application or in a written demonstration for the training promoted by the Public Employment Services.
  • Registration of the planned training, admission or current completion of the training.

Important note: when documents are provided from other countries they must be translated into Spanish or co-official language of the territory where the application is submitted by a sworn translator.

On the other hand, any foreign public document must be previously legalized by the Consular Office of Spain with jurisdiction in the country in which the document has been issued or, where appropriate, by the Ministry of Foreign Affairs, European Union and Cooperation except in the case where the document has been apostilled by the competent authority of the issuing country in accordance with the Hague Convention of 5 October 1961 and unless the document is exempt from legalization under the International Convention.

PROCEDURE 

  • Subject legitimated to submit the application: the foreign person personally, or his legal representative in the event of being minor or incapable.

  • Deadline for submission: 
  • If the enrolment of the training had an official deadline for its formalization, the application for the authorization of socio-training roots must be submitted in the two months prior to the beginning of that deadline.
  • Place of presentation:  
  • Presencialmente, en la Oficina de Extranjería de la provincia en la que la persona extranjera tenga fijado el domicilio.

  • Corresponding fee: it will accrue at the time of submission of the application, and must be paid within ten working days:

  • Time limit for the resolution of the application: three months from the day following the date on which it entered the register of the competent body for processing. Once this period has elapsed without the Administration having made the notification, it may be understood that the application has been dismissed by administrative silence. (When it has not been possible to notify the resolution, it will be announced in the Single Bulletin Board (TEU). If you have opted for electronic notification or if you are legally obliged to use that medium, the resolution will be notified by publication in the electronic headquarters. If the resolution is not accessed within ten calendar days of its publication, it will be given as notified). 
  • Accreditation of registration: the applicant within three months of notification of the decision granting the authorisation shall provide accreditation of the registration. Otherwise, the Aliens Office may terminate this authorization.  
  • Within one month of notification of the granting of the residence permit due to exceptional circumstances, the alien must personally apply for the alien identity card at the competent police station or police services in his/her place of residence.

  • The authorization granted for socio-educational roots and its extensions shall be valid for one year.  
  • The extension of the authorization granted due to socio-training roots will be conditioned on the report of the corresponding center certifying the promotion to the second course, in the case of training cycles of basic or medium degree. In the event that the training has been completed before the end of the year, the extension shall be subject to proof of the degree or certificate obtained and to being in a situation of active job search and duly registered in the public employment service.
