Sheet 59 - Cases in which the SNE allows the hiring of foreign citizens not resident in Spain

  • When the occupation is included in the catalogue of occupations of difficult coverage published by the State Public Employment Service quarterly.
  • In occupations not classified as difficult to cover when the employer accredits before the Aliens Office the difficulty of filling vacant jobs with workers already incorporated in the internal labor market. To this end, the Aliens Office will take into consideration the report submitted by the Public Employment Services, as well as the urgency of the recruitment accredited by the company.To do this, the employer must submit an offer of employment to the competent Public Employment Service in the territory where it broadcasts the job it intends to cover.
  • When the contract is directed to nationals of States with which Spain has signed International Agreements (Chile and Peru).
  • When it is a case included in article 40 of Organic Law 4/2000.They are as follows:
  • Family members regrouped in working age or the spouse or child of the foreign person residing in Spain with renewed authorization, or child of nationalized Spanish, or citizen of the European Union who has been residing in Spain for at least one year. It will provide:
    • Marriage certificate, if you are a spouse, or birth certificate, if you are a child.
    • TIE, DNI or Certificate of Registration of the relative who confers the preference.
  • Worker necessary for the assembly by renovation of a production facility or equipment.
    • It is accredited with certificate of the company.
  • Foreign person who would have been granted refugee status in the year following the cessation of the application of the Geneva Convention, or who would have been recognized as stateless in the year following the termination of the status.
    • It is accredited by presenting a certificate from the competent body accrediting the date of extinction as a refugee or stateless person.
  • Foreign persons who are responsible for ascendants or descendants of Spanish nationality. It should contribute:
    • Certificate of proof of kinship.
    • Documentation proving to be in charge (in the case of ascendants, or descendants over 18 years of age).
  • Be a child or grandchild of Spanish origin. It should contribute:
    • Documentation accrediting the relationship.
    • Documentation proving that the parent or grandparent is Spanish of origin.
  • Worker who has held work permits for seasonal activities for two natural years and has returned to the country of origin.
    • A certificate must be provided from the Spanish Consulate in the country of origin that accredits the corresponding returns.
  • Worker who has renounced residence and work authorization under a voluntary return programme after the non-return period has elapsed.
  • Coverage of trusted positions and business executives. They are those workers who carry out only their own high-management activities based on mutual trust and who legally exercise the representation of the company or have a general power extended in their favor.
    • The company’s certificate and, where applicable, general power must be provided.
  • Worker who is hired on the basis of the procedure to authorize the entry, residence and work in Spain, of foreign persons in whose professional activity there are reasons of economic, social or labor interest or whose object is to carry out research or development work or teachers, which require high qualification, or artistic actions of special cultural interest.
  • Workers in the workforce of a company or group of companies in another country who intend to develop their work activity for the same company or group in Spain, provided that it is proven that the activity of the worker requires a direct and reliable knowledge of the company.
    • Proof of belonging to the company and of the activity that the worker is going to carry out must be provided.
