The Council of Ministers has approved the Royal Decree that will begin the process of extraordinary administrative regularization for thousands of migrants who already reside in our country. The rule will be published in the Official State Gazette on Wednesday, April 15, and will enter into force the day after its publication, on Thursday, April 16.
The opening of the application period will be the same Thursday, April 16. From that day, the application can be submitted electronically. The system of prior appointment for the face-to-face processing of applications will also be opened on the same day, although face-to-face care is scheduled to begin on April 20.
This Royal Decree enables the procedure so that those people who are in an irregular administrative situation in our country and people seeking international protection can access a residence permit and legal work provided they meet the requirements. This permit will be valid for an initial period of one year. After this period, the beneficiaries will have to join the ordinary figures provided for in the Regulation on Foreigners, which allows a full and progressive integration into the system.
To do this, they will have to prove to be in the country from before January 1, 2026 and have remained in Spain uninterrupted at least five months before the time of submission of the application. In addition, it will be an essential requirement to have no criminal record and not pose a threat to public order, public security or public health. The minister, Elma Saiz, has declared that “with this process it is intended to guarantee the rights of migrants and provide legal security to the system.” She has assured that “regularization will be an agile, effective and unhindered procedure and will respond to all those who meet the requirements” and has recalled that “the term will be open until 30 June”. Social Security offices will also participate in the process, at least one each province, in the same afternoon hours of the Immigration offices and in the Post offices authorized for the process located in provincial capitals and localities over 50,000 inhabitants. The hours of attendance of the latter will be from Monday to Friday, from 08:30 to 17:30.
Authorization of residence and work
The admission to processing of the application automatically enables to reside and work throughout the Spanish national territory and in any sector of activity. The applicant will be provided with a personal Social Security number. Within one month of receiving the final favorable decision, the beneficiary must submit his application to obtain the Alien Identification Card (TIE).
The regularization process grants special protection to minors, granting a residence authorization for five years. In addition, it will be possible to manage in the same appointment and simultaneously the requests of the members of the same coexistence unit. To justify the stay in Spain, both applicants for international protection and people in an irregular administrative situation may present public or private documents or a combination of both containing personal data that can prove their identity and that are dated. For its presentation, this document must be accredited and stamped by the competent authorities, either the Entities registered in the Electronic Registry of Foreigners Collaborators (RECEX) or the social services.nbsp;
Accompaniment during the process
The Administration and the potential beneficiaries will be able to count on the collaboration of the lawyers specialized in the field of foreigners, who play an essential role in the legal advice and in the correct processing of the files. These professionals will be able to accompany the applicants throughout the process and act, where appropriate, as their representatives, roles that will also be performed by social graduates and administrative managers.
In addition, technical sessions will be developed in collaboration with the General Council of the Legal Profession, thus strengthening institutional coordination and legal rigor in the application of this procedure.
In addition, the Ministry has created a Register of Foreigners Collaborators (RECEX) in which trade unions and non-profit entities have been registered to advise and help the interested persons who have been accredited to have at least two years of experience. These entities, whose list will be updated on the website of the Ministry of Inclusion, have created a census of people qualified to act as representatives of those interested in the telematic application. Your collaboration will be free. To resolve doubts when making the request, a communication channel has been enabled through the telephone 060, from Monday to Friday, from 09:30 hours to 14:00 hours and from 16:30 hours to 19:30 hours.
