Functions
- To act as representative of the General Administration of the State for the purpose of establishing open public promotion occupational pension funds (FPEPP) and to adopt the necessary legal acts for their implementation.
- Select the managing and depository entities in accordance with articles 63 and 65 of the consolidated text of the Law on the Regulation of Pension Plans and Funds and establish the requirements and conditions of adjudication.
- Establish and approve a common investment strategy framework that will be stable and long-term, which should be reviewed at least every five years.
- The representation of the FPEPP until the constitution of the Special Control Commission.
- The adoption of the decision to dissolve the open public promotion occupational pension fund.
- Be expressly informed about the decisions of outsourcing of activities by the management entity that will be communicated to you by the Special Control Commission.
- Ensure the proper functioning and good governance of the FPEPP and, in particular, their investment policy.
- Ratify the subsequent modifications of the rules of operation of the FPEPP, the changes of denomination of the pension fund and the replacement or new designation of management or depository entity.
- Receive the approved Annual Accounts of the managing and depository entities of the FPEPP.
- Communicate to the Special Control Commission the resolution of the contract as a management or depository entity within 15 days.
- To appoint or designate one or more of its members to participate, on behalf of the Commission, in the formation of pension funds together with the managing entity and the depositary entity.
- If it finds that a management or depository entity or the Special Control Commission is not complying with the provisions applicable to it, it shall call for compliance with those provisions and, in the absence of any adequacy thereof, the Promotion and Monitoring Commission shall inform the Directorate-General for Insurance and Pension Funds accordingly, with a view to taking appropriate measures to ensure that the management or depository entity or the Special Control Commission puts an end to such irregular situation.
- Urge the most representative trade union organizations, the most representative business organizations and the MISSM to propose their candidates to serve as members of the Special Control Commission, within one month of the establishment of the first public promotion fund.
- To inform the proponents of the candidates to be members of the Special Control Commission of their nomination as such.
- To convene the members of the Special Control Commission for its constitution, within one month from the date on which all members are appointed.
- Receive from management entities, depositaries and external auditors, on an annual basis and in the month following the formulation of the annual accounts, a report on detected incidents and proposals for improvement in the functioning of public promotion pension funds and, in particular, on improvements in their governance.
- Receive the minutes of the meetings of the Special Control Commission.
