This report was commissioned by the “Judgement Analysis” working group, part of the Monitoring Committee of the Inter-institutional Cooperation Agreement against racism, xenophobia and other forms of intolerance.
The report aims to shed light on how hate crime legislation is enforced, including strengths and weaknesses and describing the characteristics of the judgements selected. To do so, a sampling of judgements issued by the courts was selected. The main results of the study are divided into four major sections: the characteristics of the hate crimes; the profile of the defendants; the profile of the victims; and issues related to sentences and other legal factors. The last chapter is devoted to conclusions and the methodology’s limitations, and difficulties in obtaining results based mainly on the lack of detailed information and the complexity of existing databases.
