The Office of Democratic Institutions and Human Rights of the Organisation for Security and Cooperation in Europe (OSCE) and the International Association of Prosecutors (IAP) put out this publication in English in 2014. This version, translated into Spanish, is the result of cooperation between the Spanish Ministry of Foreign Affairs and Cooperation, Spain’s General Prosecution, and the Secretariat General for Immigration and Emigration under the Ministry of Employment and Social Security through the Spanish Observatory on Racism and Xenophobia (2016).
This tool is aimed at helping legal operators and others stakeholders in their functions with a view to prosecuting hate crimes. The Guide was compiled by experts from different OSCE countries and applies to different legal systems and legal frameworks. It contains a number of practical cases.
The guide comprises conceptual definitions of terms, the legal nature of hate crimes, tools for prosecuting hate crimes and four annexes with information of interest such as ODIHIR programmes and resources to combat hate crimes; OSCE Ministerial Council decisions on hate crimes, a catalogue of fundamental international tools and case law from international courts; and, finally, the engagements of the International Association of Prosecutors.
