, from 17 July 2008, which sets precedent on jurisprudence regarding equal treatment and non-discrimination on grounds of disability.
The Equal Treatment Directive should not be interpreted as being restrictive, that is, exclusively aimed at people with disabilities. Rather, the Directive also “protects those people who, not having a disability themselves, suffer direct discrimination or harassment in their workplace and occupation for being linked to a person with a disability .

Judgment of the European Court from 10 July 2008
The judgment has its origin on the claim that was presented by the Centre for equal opportunities and combating racism from Belgium against Firma Feryn NV for the public statement that an employer made, stating that his company would not recruit “immigrant employees”. The fact that an employer states publicly that it will not recruit employees of a certain ethnic or racial origin constitutes direct discrimination in respect of recruitment.
