El Gobierno agiliza trámites y elimina obligaciones burocráticas en la gestión de la Incapacidad Temporal

The Government, on the proposal of the Ministry of Inclusion, Social Security and Migration, has approved changes to the Royal Decree regulating certain aspects of the management and control of processes for temporary disability (IT) in the first 365 days of its duration, in order to speed up procedures and eliminate bureaucratic obligations that unnecessarily prolong processes, which is an important benefit for companies, workers and for the Public Health Services’ own doctors.

Thus, with regard to the medical parts of low and high, only one copy will be delivered to the worker; both the second copy is eliminated, and the obligation for the worker himself to deliver this copy in the company, management entity or mutual. The communication between the issuing entities and the INSS will be telematic, avoiding procedures that may be burdensome for people who are temporarily incapacitated and taking advantage of the possibilities to improve the efficiency and effectiveness offered by advances in digitization and information technologies.

In addition, it is clarified that, in the IT processes, the doctors of the Public Health Service, the collaborating company or the mutual company may set medical review deadlines lower than those indicated in the Royal Decree, depending on the evolution of the process. This is to avoid interpretative doubts caused by the current wording of the rule.
