Benefits for birth and leave

Social Security has processed 236,112 birth and child care permits in the first half of the year

Social Security processed 236,112 birth and childcare benefits in the first six months of 2022, of which 112,259 were for the first parent, usually the mother, and 123,853 for the second parent, usually the father.


 

The cost of the birth and child care allowance between January and June of this year was €1,596.5 million. In 2021, this figure stood at 1,369.1 million, an increase of 16.6%.

The childbirth and childcare benefit, which replaced the old maternity and paternity benefits, came into force on January 1, 2021 and has meant the complete equalization of both. Currently, the leave is 16 weeks for both parents and is recognized as an individual and non-transferable right. Of the 16 weeks, six of them must be enjoyed immediately after childbirth or judicial or administrative resolution in cases of adoption, custody or placement. The rest of the time can be arranged in successive periods.

The amount of these benefits is equivalent to the contribution base of the month prior to childbirth, adoption, care or fostering, and is paid directly by the National Social Security Institute (INSS) during the weeks of the leave.

By autonomous communities, the highest number of benefits for birth and child care has been recognized in Andalusia (42,206), Catalonia (42,073), Madrid (40,987) and the Valencian Community (23,770).

The National Institute of Social Security offers the possibility of applying for the birth benefit telematically, through the portal Tu Seguridad Social (https://sede.seg-social.gob.es/) and through the form in https://tramites.seg-social.es/acceso/prestacion-nacimiento-cuidado-menor.html

Successive rest periods may also be requested electronically for the birth or care of the child, if the parents choose to divide the period.

Leave of absence for child care, foster child or family member

On the other hand, the number of surpluses registered in the first half of the year was 17,140, of which 14,839 corresponded to women, 86.6%, and 2,301 to men, which is equivalent to 13.4%.


 

The number of surpluses has been reduced on average by 22.7% compared to the same period of the 2021 financial year.

Madrid (4,088), Catalonia (3,319), Andalusia (2,480), the Valencian Community (2,222), and the Basque Country (2,567) are the autonomous communities with the most processed surpluses.

Fewer surpluses have been registered in all the autonomous communities than last year. The main decreases in the first semester were in Cantabria (-23.0%), Madrid (-22.9%) and Aragón (-22.6%) and Castilla y León (-22%).

Workers may apply for leave to care for children or minors who have been taken in or for the care of other family members. The first three years of leave to care for a foster child are considered an effective contributory period for the purposes of Social Security benefits for retirement, permanent disability, death and survival, maternity and paternity. The first year of leave to care for other family members is also considered to be actually paid for the purposes of these benefits.
