What would happen with your unemployment benefit?
The planned transitional period on the Brexit withdrawal agreement for which it has been kept the use of the Union acquis in the United Kingdom finished on December the 31st, 2020.
On December 24th, 2020, the Future UK-EU Relationship was achieved, which will be applied temporarily until its full ratification.
From January 1st, 2020, the UK and Spain will follow having jurisdiction to manage their social security benefits based on the contributions carried out in each country, under equality and non-discrimination conditions.
Likewise, from January 1st, 2021, the Future UK-EU Relationship establishes, about unemployment benefits, that legal residents in an EU country or UK can aggregate periods of insurance:
- Aggregation of periods of insurance:
- National citizens of the UK that resides in Spain legally will be able to enforce all the contributions paid in the EU, including the UK, provided that the last job took place in Spain.
- Nationals from the EU, EEA, and Switzerland will be able to enforce their contributions paid in the British social security, provided that their last job took place in Spain.
On the other hand, concerning the recognition of the Spanish benefits, frontier workers who reside in Spain and work in Gibraltar, periods of insurance will be considered, both before and after the end date of the transitional period 31/12/2020.
What situation are you in?

The benefits will be recognized by the State where you did your last job.
If you have completed the most recent period of insurance in Spain, the periods worked in the United Kingdom and Spain will be considered.
In other words, if you have carried out your last work activity in Spain, you must apply here for unemployment benefits and provide the document issued by the United Kingdom stating the periods of work in said country.

The frontier worker residing in Spain who carries out his activity in Gibraltar will consider the periods of unemployment contributions in Gibraltar, both before and after the withdrawal date, whether he works last in Spain or if he has exercised his right as a frontier worker in the UK and continue to do so without interruption.

To access unemployment protection after return, it is necessary to obtain the document accrediting periods of insurance and/or employment and benefits received in the United Kingdom.
Depending on the situation in which you find yourself, you will be able to access the contributory benefit, based on the contributions accredited in Spain before going abroad that had not been used, or totalling the contributions made in the United Kingdom if you work in Spain after your return.
